We advise on all areas within media law, including classic publishing agreements, agreements with collecting societies, record contracts, TV production agreements, format agreements, merchandise agreements, event and concerts as well as radio and television distribution agreements, etc.

In addition, we provide highly specialised advice on internet-based distribution forms. The development towards more streaming and on-demand content has resulted in a number of challenges facing both rights holders, distributors and collecting societies. We advise on the complex legal challenges relating to the new distribution forms of music, film, radio and television on all platforms, and we assist in connection with negotiation of distribution and licence agreements. We also advise on the legal challenges in connection with E-books and knowledge/article databases.

We also have wide expertise within social media and the new challenges arising in line with the development and expansion of social media. We advise on personal data law, which is of significant importance to providers. We also assist in connection with issues concerning rights and the development and distribution of apps and other digital content services.

As much exploitation and distribution of content take place across borders today, our advice is often provided in close co-operation with our many international co-operation partners. We also work closely together with our own IT law team as well as our marketing law team, which has wide experience in consumer and e-commerce issues arising in connection with digital distribution, including issues regarding EU cookie legislation, personal data legislation, payment services and payment substitutes.

Horten is the market leader within gaming legislation and has been heavily involved in the liberalisation of the Danish online gaming market. Our clients include all stakeholders with an interest in the provision of games: Game providers holding a licence to provide games in Denmark; platform providers; other sub-contractors to the licence holders; payment card providers; payment service providers; interest groups, etc.

In co-operation with Horten's M&A team, our Media and Entertainment team has assisted in connection with a number of mergers, sales and acquisitions within the media industry (including radio and television stations and publishers), and we have wide experience advising on the transactions as well as the challenges relating to rights. The typical issues are format rights, licence and distribution agreements and broadcasting licences, and our strong network and knowledge of the industry ensure prompt clarification of such issues, which are typically a decisive prerequisite for a successful transaction.
