In connection with the new Rent Act, the Ministry of Housing and Urban Affairs will introduce a new version of the lease agreement for residences. The new form will be called "typeformular A, 9. udgave" and must be applied from 1 July 2015.
The form is to be used in connection with all written lease agreements containing equal terms for several lessees in the same property when these terms appear in such a way that the lessees consider them to be standard terms.
Recently, the Supreme Court found that it is decisive whether the lease agreement appears to have been prepared individually or in such a way that the lessee considers the terms to be standard terms.
Standard lease agreements that are not prepared using the authorised form are not invalid in their entirety, but all terms imposing more extensive obligations on or providing fewer rights to the lessee compared to the Rent Act will be invalid.
The requirement for use of the authorised form does not only apply to lease agreements concluded in connection with the establishment of the tenancy, but also to later supplements etc.
