Horten is highly specialised within state aid. Our expertise covers all aspects of state aid and we have in recent years been involved in many of the largest state aid cases in Denmark.
Our experts have wide experience predicting and handling the often rather complicated state aid issues. We have assisted a number of municipalities and regions with the state aid implications of large infrastructure projects. We take a proactive approach and focus on the recent development by holding courses and writing articles about state aid.
As a supplement to our legal expertise, we are capable of handling and providing advice in a political environment. We have thorough insight into the political processes and many years' experience conveying a legal message to an audience which does not necessarily have a legal background.
Our clients within state aid are primarily municipalities, regions, public companies and other entities in receipt of public funds. We also have experience advising private enterprises which (often inadvertently) have received state aid.

Aid to the Eurovision Song Contest was not illegal under municipal and state aid law

On 12 October 2016, the Ministry of Social Affairs and the Interior concluded in a statement that the aid provided through Projektselskabet by the City of Copenhagen and the Capital Region of Denmark to the Eurovision Song Contest in 2014 was legal.
New state aid register will come into force on 1 July 2016

As part of the European Commission's reform of the European state aid rules initiated in 2012, the member states must register any state aid to companies exceeding € 500,000 in a public web-based register. The rule comes into force on 1 July 2016, when the new register will be available.

This was established on 25 January 2016 when the Western High Court ruled on a dispute between the Municipality of Sønderborg and two local district heating companies. The ruling means that the municipality is obligated to charge a guarantee commission which constitutes more than DKK 70 million in the guarantee period.
