New online dispute portal and requirements for web shops

In the future, all Danish and EU web shops must link to the pan-European online dispute portal ODR (Online Dispute Resolution). ODR will be available from 15 February 2016.

On 15 February 2016, the new European ODR platform will be launched. The platform will ease the processing of consumers' complaints about products and services purchased online and make it possible for EU consumers to complain directly to the European company where the unsatisfactory product/service was purchased.

The Commission will operate the ODR platform.

DUTY OF DISCLOSURE FOR WEB SHOPS

The establishment of the ODR platform implies that owners of web shops available to EU consumers are obligated to inform about the ODR platform and its possibilities of resolving disputes between the web shop and the consumer in connection with the online purchase.

The business operator must link to the ODR platform and state its own e-mail address on the web shop and in its general terms. This information must also be disclosed if the business operator sends marketing material to the consumer via e-mail.
