Horten represents food manufacturer in Denmark's most important case within the food area

Horten is currently representing a food manufacturer in a major financial case - previously described by the food authorities as "Denmark's most important case" within the food area.

The case involves a number of fundamental questions on e.g. the construction of the EU Fruit Juice Directive, the Ministerial Order on Fruit Juice and the Danish Food Act in connection with delivery of concentrated fruit juices across borders.

The case was the result of the food authorities' unilateral construction of the rules, and it concerns the requirements for companies' description of their products in connection with B2B sale (business-to-business sale) - in particular when exporting to other EU countries or third countries where Denmark's special rules do not apply, and where the EU directives and regulations are construed and enforced differently than in Denmark.

The case will be concluded after Easter. The food manufacturer is represented by attorney Kristine Lilholt Nilsson from Horten's Life Science team and attorney Jakob S. Arrevad from Horten's litigation team.
